Kaku Connect: Terms of Service

Effective Date: June 5, 2025

Welcome to Kaku Connect! This document outlines the rules for using our mobile application (“App”) and its services. By using Kaku Connect, you (“you” or “User”) agree to these terms. If you don’t agree with any part, please do not use our App.

1. Your Agreement to These Terms

When you create an account, download, install, or use Kaku Connect, you are agreeing to these Terms of Service and our Privacy Policy. This forms a legal contract between you and JOMEEN MIMAR PRIVATE LIMITED (“Kaku Connect,” “we,” “us,” or “our”).

2. Eligibility and Account Registration

To use our platform, you must:

  • Be at least 12 years old (or the legal age in your area).

  • Have the authority to agree to these Terms on behalf of yourself or a legal entity you represent.

When you sign up for an account, you agree to:

  • Provide accurate, current, and complete information.

  • Keep your login credentials secure and confidential.

  • Be responsible for all activities that occur under your account.

  • Notify us immediately of any unauthorized use of your account.

We can suspend or close your account if you violate these Terms or misuse the platform.

3. User-Generated Content (UGC) Guidelines & Our Strict No-Tolerance Policy

Kaku Connect is a platform designed to connect people through shared hobbies and interests, allowing users to share videos and photos (“User Content”). We are committed to fostering a positive, inclusive, and safe community. Therefore, we maintain a strict, zero-tolerance policy against objectionable content and abusive users.

You agree not to create, upload, post, or transmit any User Content, or behave in any way that is:

  • Illegal or Harmful: Such as content that promotes hate, discrimination, violence, harassment, or is defamatory, vulgar, obscene, or invades privacy. This includes, but is not limited to, content promoting discrimination, bigotry, racism, hatred, harassment, or physical harm against any individual or group.

  • Infringing: Content that violates someone else’s copyrights, trademarks, or other intellectual property.

  • Spam or Ads: Unwanted advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of commercial solicitation.

  • Malicious: Viruses, malware, or other harmful code designed to interrupt, destroy, or limit software or hardware functionality.

  • Misleading: Impersonating others or misrepresenting your identity or affiliation.

  • Violates Laws: Anything that breaks local, national, or international laws.

  • Exploits Minors: Content that harms or attempts to harm children in any way, including exposing them to inappropriate content or asking for personally identifiable information.

4. Moderation, Reporting, and Enforcement

4.1. Content Review

We use both automated tools and human review processes to detect and filter objectionable content. All new and edited User Content (e.g., “Feats,” “Waves”) is subject to an internal manual approval workflow before becoming publicly visible.

4.2. Report Abuse

You can easily report any objectionable content or abusive behavior you encounter within the App using our in-app reporting feature.

4.3. Our 24-Hour Action

When we receive a valid report, our moderation team will review it within 24 hours. If a violation is found, we will immediately remove the offending content and take strong action against the responsible user, which may include temporary suspension or permanent ejection (account termination) from the App. Users who submit reports will receive email notifications about the status of their report.

4.4. Blocking Users

You have the ability to block other users. Blocking prevents them from seeing your content or messaging you, and vice-versa. You can manage your blocked users list in your settings.

5. User Conduct

Please use Kaku Connect respectfully. Do not harass, cause distress to, or otherwise disrupt other users. Do not post offensive content or interrupt normal conversations.

6. Account Suspension & Termination

We can suspend or close your account at any time, without notice, if you violate these Terms (especially our UGC Guidelines) or if your actions harm other users or the App. You can also close your account anytime through the App.

Upon termination, your right to use the App will cease, but we may retain certain information for legal or operational reasons.

7. Content Ownership

7.1. Your Content

You own the photos, videos, and messages you create and share on Kaku Connect. By posting content, you grant Kaku Connect a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, host, store, modify, reproduce, display, publish, adapt, and distribute your content as necessary to operate, promote, and improve our services, and to develop new ones.

7.2. Our Content

Kaku Connect owns the App itself, including its trademarks, logos, and software. You cannot copy, modify, or sell any part of our App without our express written permission.

8. Privacy

Our separate Privacy Policy explains how we collect, use, and protect your personal information. By using the App, you agree to our data practices described there.

9. Third-Party Links

Our App may link to other websites or services not controlled by us. Kaku Connect is not responsible for their content or practices. Your use of third-party services is subject to their own terms.

10. Limitation of Liability

To the fullest extent allowed by law, Kaku Connect shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or profits, arising out of or in connection with your use of the App.
Our total liability for any and all claims related to your use of the App will not exceed any amount you paid us in the last twelve (12) months.

11. Indemnification

You agree to protect and defend Kaku Connect, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) that arise from your use of the App, your violation of these Terms, or your infringement of anyone else’s rights.

12. Changes to These Terms

We may update these Terms occasionally. Any changes will be posted here and will become effective immediately. We may notify you of major changes. By continuing to use the App after changes are made, you agree to the new terms.

13. Governing Law

This Agreement is governed by the laws of India, without regard to its conflict of law principles. Any disputes will be resolved in the courts located in West Siang, Arunachal Pradesh, India.

14. Miscellaneous

  • If a Part is Invalid: If any part of these terms is found to be invalid or unenforceable, the rest of the terms remain in full force and effect.

  • No Waiver: If we don’t enforce a right in these terms, it doesn’t mean we’re giving up that right.

  • No Assignment: You cannot transfer your rights or obligations under this Agreement without our written permission. We may transfer ours.
